CITY OF KOTA KINABALU (PROVISIONS OF PARKING PLACES) BY-LAWS, 2003 [SABAH NO L.8/2003]

G.N. No. : S. 11/73 Ordinance No. 11 of 1961 In exercise of powers conferred upon him by the Local Authority (Assignment of Functions : The Provisions of Parking Places and Stands) Order, 1973 and all the enabling powers vested by the Local Government Ordinance, 1961 (as amended by City of Kota Kinabalu Enactment, 1996), the Mayor of the City of Kota Kinabalu thereinafter referred to as "the Mayor", with the approval of the Chief Minister, has made the following By-laws:

1. Citation and commencement These By-laws may be cited as the City of Kota Kinabalu (Provisions of Parking Places) By-laws, 2003 and shall come into force on the date of its publication in the Gazette..

2. Interpretation In these By-laws, unless the context otherwise requires - "controlled hour" means the period specified in column 4 of Table 1 of the First Schedule to these By-laws or such period as the Mayor may from time to time prescribed, during which the parking charge is payable; "half hour" includes part of a half hour; "hour" includes part of an hour; "two hours" includes part of two hours; "half hourly parking", "hourly parking" and "two hourly parking" mean a parking place described in column 3 of Table 1 of the First Schedule to these By-laws, wherein a motor vehicle is allowed to be parked half-hourly or hourly or two hourly as the case may be, on payment of the parking charge; "length of road" means the entire length of the road as named in the First Schedule to these By-laws; "motor vehicle" means any vehicle propelled by means of mechanism or adopted as to be capable of being used on a road; "park" means to stop a motor vehicle but does not include stopping -

(a)only for such time as is reasonably necessary to take up or set down passengers or load or unload goods; (b)in obedience to traffic signs or signals; (c)in case of accident or to avoid accident; or (d)involuntarily "parking" includes waiting in a parking space; "parking attendant" or "parking inspector" means any person appointed under by-law 11 and includes a person duly authorized by or on behalf of the Mayor to perform, supervise, manage and keep in charge of any parking space or to do any act under these By-laws; "parking space" means the space marked out in a parking place for the parking of one motor vehicle; "person" includes a company, a partnership, a group of persons and a corporation sole; "parking charge" means the charge prescribed in Table 1 and Table 2 of the First Schedule to these By-laws; "road" includes any road, street, highway, square, bridge, kerb, sidewalk, pavement, parade, footway or passage, whether a thoroughfare or not, over which the public have a right of way or to which the public have access and also includes any road, footway or passage, open court or open alley, used or intended to be used as a means of access to two or more houses, whether the public have a right of way thereover or not, and all grass verges, islands, road dividers, the channels, drains and ditches at the side of any road; "taxi" means a taxi cab or hire car which in the usual course of business plies for hire within or outside the boundaries of the City of Kota Kinabalu area.

3. Powers to provide parking places The Mayor hereby provides that the road, length of road or place within the jurisdiction of the City of Kota Kinabalu specified in column 1 of Table 1 of the First Schedule to these By-laws shall be parking places for motor vehicles other than buses and taxis. .

4. Parking plates for taxis or any other public transport vehicles (1) The Mayor may reserve as parking places for taxis or any other public transport vehicles any road, stretch of road or place not specified in column 1 of Table 1 of the First Schedule to these By-laws and any such reservation may be revoked at any time by the Mayor without giving any reason whatsoever. (2) Any road, stretch of road or place reserved by the Mayor under paragraph (1) of this by-law shall be marked "Teksi Sahaja " or any suitable signage and shall be used exclusively and solely for such purpose subject however to such conditions and restrictions or payment of such charges as the Mayor may deem fit to impose.

5. Restriction on parking other'than in a parking place (1) No person shall at any time park any motor vehicle at any places or spaces on any road or length of road within the City of Kota Kinabalu except where such areas or spaces have been specially designated by the Mayor as parking places or spaces. . (2) No person shall park or stop or permit or cause to be parked or stopped any motor vehicle in any road reserve, road shoulder, road divider or any other ground maintained by the Mayor. (3) Without prejudice to paragraph (1) of this by-law, the Mayor may designate any road or length of road for parking purposes,

Parking system (1) The Mayor shall have the absolute discretion to determine and implement the types of parking system including the coupon parking system or any other parking system which is deemed suitable and the manner in which it is to be managed. (2) Every person using such parking spaces shall comply with all the conditions and restrictions imposed by the Mayor including the conditions as to the method of payment relating to the use of such parking spaces.

7. Condition and restriction for use of parking space (1) Any person or driver in control of any motor vehicle shall park the said motor vehicle in any parking spaces for such motor vehicle provided by the Mayor under by-law 5 (1). (2) Every person using such parking spaces shall comply with all the conditions and restrictions imposed by the Mayor including the conditions as to the method of payment relating to the use of such parking spaces.

8. Parking spaces (1) A parking place may be divided into parking spaces and for the purpose of determining the parking spaces the Mayor shall cause each parking space to be indicated by painted lines, studs, signs or other indications. (2) There shall be erected at a parking place a sign or notice board on which shall be affixed a notice stating the substance of these By-laws and the parking charge. (3) On the application of any firms, companies, institutions or other organizations including those mentioned below, the Mayor may at his own discretion reserve parking spaces for such firms, companies, institutions or other organizations at a charge as may be prescribed by the Mayor from time to time subject to such conditions and restrictions as he deem, fit1 to impose -

(a)banks; (b)hotels; and (c)clinics. (4) The Mayor reserves the right to revise such parking charge from time to time as deem necessary and any such reservation may be revoked at any time by the Mayor without giving any reason whatsoever.

9. Monthly parking ticket in a parking space designated for half hourly or hourly or two hourly parking (1) On the application of any owner of a motor vehicle the Mayor may, upon payment of the fee as hereinafter prescribed, issue to such applicant a monthly parking ticket which shall entitle the motor vehicle to which it relates to be parked in any parking space designated for half hourly or hourly or two hourly parking which is not reserved under by-law 8 (3) of these By-laws without further payment of the parking charge during the period for which the monthly parking ticket is issued. (2) The monthly parking ticket shall be clearly displayed on the left side of the windscreen of the motor vehicle for which it is issued. (3) Such monthly parking ticket shall be valid for the month for which it is issued. (4) The maximum fee for a monthly parking ticket shall be -

(a)RM500.00 for parking place designated as Type B parking as described in Table 2 of the First Schedule to these By-laws; and (b)RM180.00 for parking place designated as Type C or D or E parking as described in Table 2 of the First Schedule to these By-laws. (5) The Mayor is neither bound to ensure that the driver or owner of a motor vehicle to which a monthly parking ticket is issued, is able to secure a parking space for parking of the same motor vehicle in a parking place where he is entitled for parking, nor the Mayor is bound to secure the same for the driver or owner of a motor vehicle for the same purpose.

10. Parking spaces for loading and unloading (1) The Mayor may at his own discretion, reserve any parking space or spaces for the loading and unloading of goods and any such reservation may at any time be revoked by the Mayor. (2) Any such parking space or spaces reserved by the Mayor under paragraph (1) of this by-law shall be marked "UntukMuatan dan Punggahan Sahaja"and shall be used exclusively and solely for such purpose subject however to such conditions and restrictions as the Mayor may deem fit to impose.

11. Parking attendants or inspectors The Mayor may appoint one or more parking attendants or inspectors to be on duty at any parking place provided by the Mayor.

12. Method of parking (1) No person shall park a motor vehicle in a parking space across any line marking the parking space or in such a position that the said motor vehicle shall not be entirely within the area delineated as parking space. (2) A person parking a motor vehicle in a parking space shall subject to the provision of paragraph (1) of this by-law cause such vehicle so far as the lines marking the parking space permit to face the general direction of traffic and shall conform to all signs and signals exhibited in such parking place. (3) Where any motor vehicle is parked in a parking space in contravention of the foregoing provisions a parking attendant or inspector may alter or cause to be altered the position of the vehicle in order that its position shall comply with those provisions and the driver or person in charge of such vehicle shall comply with such lawful instructions as a parking attendant or inspector or a police officer in uniform may give an order to comply with the provisions of these By-laws.

13. Payment of parking charge and lawful directions by a parking attendant or inspector (1) Any person using any parking space shall

(a)obey all lawful directions given to him by a parking attendant or inspector or any person duly authorised in writing by the Mayor; (b)pay the parking charge as soon as his motor vehicle is parked in any such parking space by handing over the money to the parking attendant or inspector who shall issue an official receipt on which shall be written the registration number of the motor vehicle, the amount paid, the location, the date and the time which the motor vehicle is authorised to be parked at such parking space. The parking attendant or inspector shall thereupon affix duplicate copy of such official receipt on the left side of the windscreen or any conspicuous part of the motor vehicle; and (c)where a coupon parking system or any other parking system is used or implemented, such coupon or payment advice shall be displayed with the appropriate parking charge on the dash board or at the front window on the right hand side of the motor vehicle. (2) The provision of sub-paragraphs (b) and (c) of paragraph (1) of this by-law shall not apply to a motor vehicle parked or to be parked in a parking place in respect of which a valid monthly parking ticket had been issued under by-law 9. (3) Any person using a parking space in respect of which a valid monthly parking ticket had been issued under by-law 9 of these By-laws shall-

(a)obey all lawful directions given to him by a parking attendant or inspector or any person duly authorised in writing by the Mayor; and (b)display the parking ticket on the left side of the windscreen or any conspicuous part of the motor vehicle. 14. No parking without parking ticket or coupon or payment advice No person shall - .

(a)park or cause or permit to be parked any motor vehicle in any parking place unless the parking charge is paid and a receipt is issued by the parking attendant or inspector or a coupon or payment advice is displayed indicating that such payment has been made; (b)continue to park or cause or permit to continue to be parked a motor vehicle in a parking space after the expiry of the period during which such motor vehicle is authorised to be parked in such parking space as stated in the official receipt issued by the parking attendant or inspector or coupon or payment advice unless by the subsequent additional payment of the parking charge to the parking attendant or inspector or additional coupon or payment advice with the appropriate parking charge is displayed; and (c)park or continue to park or cause or permit to continue to be parked any motor vehicle in a parking space in respect of which a monthly parking ticket issued under by-law 9 of these By-laws has expired. 15. Advice note or compound (1) Where a motor vehicle is parked in contravention of by-law 14, it shall be the duty of the parking attendant or inspector to issue an advice note or compound to be affixed to the windscreen or any conspicuous part of the motor vehicle requesting the registered owner or any person in charge of such motor vehicle to pay the appropriate parking charge before the expiration of a grace period of 21 days of the issuance of such advice note or in the case of the coupon parking system, to pay the compound within 60 days from the date of the issuance of such compound. Such advice note or compound shall contain the following particulars-

(a)the registration number of the vehicle; (b)the date of issue; (c)the time of issue; (d)the parking charge or compound payable; (e)the location or zone of the parking place; and (f)the parking space number. (2) If a motor vehicle for which an advice note has been issued remains parked after the expiry of half an hour, an hour or two hours, as the case may be, as specified under column 3 of Table 1 of the First Schedule to these By-laws, from the time of the issue of the previous advice note, the parking attendant or inspector shall issue another advice note and shall continue do so at the end of every half hour, hour or two hours as the case may be. (3) If a motor vehicle remains parked continuously in the same parking space after the expiry of each of the half hourly or hourly or two hourly duration as the case may be, as specified under column 3 of Table 1 of the First Schedule to these By-laws, such motor vehicle shall be charged for the duration of every subsequent half hour or hour or two hours or part thereof with the parking charge as specified in Table 1 and Table 2 of the First Schedule to these By-laws. Parking continuously in the same parking space.

16. Excess charge Any person who acts in contravention of by-law 15(1) and (2) shall, on being notified in writing of such contravention by the Mayor or by any officer duly authorised on his behalf, pay to the Mayor within 30 days from the date of such notification and at a place specified therein - Excess charge.

(a)an excess charge of RM5.00 or such excess charge as the Mayor may from time to time prescribed in addition to the parking charge for every period thereof during which the motor vehicle has remained parked in the parking place without payment of the parking charge; or (b)an excess charge of RM5.00 or such excess charge as the Mayor may from time to time prescribed in addition to the parking charge for every period thereof during which the motor vehicle has remained parked in the parking place after the expiry of the authorised parking period, Provided that - (i)such excess charge shall not exceed RM50.00 on any one occasion and shall be paid to the Mayor at his office during normal working hours and the Mayor shall issue an official receipt therefor; and (ii)the provision of sub-paragraphs (a) and (b) of this by-law shall not apply if the person acting in contravention of by-law 15 pays not later than 21 days from the day such contravention has occurred to the parking attendant or inspector on duty or to the Mayor at his office the parking charge in compliance with by-law 15. (c)Any person who acts in contravention of by-law 15 (3) by means of pulling, destroying or replacing the parking ticket or receipt or advice note or compound or payment advice shall, on being notified in writing by the Mayor or by any officer duly authorised on his behalf, pay a compound not exceeding RM5 0.00 on any one occasion to the Mayor within 30 days from the date of such issuance or notification of such compound at his office during normal office hours and the Mayor shall issue an official receipt therefor. Compound for acting in contravention of bylaw 15 (3). (d)in the case of a coupon parking system or any other parking system, the rates of compound imposed shall be : Types of infrigement and rates of compound under coupon parking system. Types of infringement Rates of compound (For Central Business District Area specified from Item 1 to Item 125 of Table 1 of the First Schedule to these By-laws) (For outside Central Business District Area specified from Item 126 to Item 632 of Table 1 of the First Schedule to these By-laws) (i) Parking vehicle and displaying an invalid coupon or payment advice or monthly parking ticket. RM50.00 RM20.00 (ii) Parking vehicle exceeding the validity period of the coupon or payment advice or monthly parking ticket. RM50.00 RM20.00 (iii) Parking vehicle and displaying an unauthorised coupon or payment advice or monthly parking ticket. RM50.00 RM20.00 (iv) Parking vehicle and displaying a coupon or payment advice or monthly parking ticket with particulars of number, date, month, day, time and period of parking and vehicle registration number covered, or not visible or blocked. RM50.000 RM20.00 (v) Parking vehicle and displaying a coupon or payment advice or monthly parking ticket with a different vehicle registration number. RM50.00 RM20.00 (vi) Parking vehicle and displaying coupon or payment advice or monthly parking ticket that has been altered, erased or other alterations indicating that it has been tampered with. RM100.00 RM40.00 (vii) Failure to display a coupon or payment advice or monthly parking ticket when parking in a car parking space. RM100.00 RM40.00 Provided that such compound shall not exceed RM100.00 on any one occasion and shall be paid to the Mayor at his office or at a place specified therein during normal working hours within 60 days from the date of such issuance and an official receipt shall be issued therefor.

17. Failure to pay excess charge or accumulated excess charge or compound A failure by any person in charge of a motor vehicle to pay up the excess charge or accumulated excess charge or compound within the prescribed time shall render such motor vehicle subject to be removed by the Mayor or any officer duly authorised by him at any time in such manner as the Mayor thinks fit. Such motor vehicle may be subject to the detention by the Mayor so long as the excess charge or accumulated excess charge or compound is unpaid.

18. Restriction against parking second time on original ticket (1) No person having removed his motor vehicle from a parking space before the expiry of the authorised period for parking of such motor vehicle shall be entitled to park such motor vehicle in the same parking space a second time without further payment of the parking charge notwithstanding that the original authorised period has not yet expired. (2) The provisions of paragraph (1) of this by-law shall not apply to a person who is a holder of a valid monthly parking ticket under by-law 9.

19. Safety of other motoi vehicles No vehicle shall be drawn, driven or pushed within a parking place otherwise than in an orderly and careful manner and with due regard to the safety of other motor vehicles or persons within the parking place.

20. Suspension and limitation of use of parking place or space (1) The Mayor may suspend or limit the use of a parking place or space whenever he considers that such suspension or limitation is necessary -

(a)for the purpose of facilitating the movement of traffic or promoting its safety; (b)for the purpose of carrying out any construction, demolition work or excavation adjacent or close to the parking place or maintenance, improvement or reconstruction of the parking place or the laying, erection, alteration or repair in or adjacent or close to the parking place of any sewer or of any cable, pipe, main or apparatus for the supply of water or electricity or of any telegraphic line; (c)for the convenience of occupiers of premises adjacent or close to the parking place on any occasion or for the removal or delivery of furniture goods from or to any such premises; (d)on any occasion on which it is likely by reason of some special attraction or occasion that any road will be congested or obstructed; (e)for the convenience of occupiers of premises adjacent or close to the parking place at the time of weddings or funerals or other special occasions; or (f)for any other reason as the Mayor may deem fit. (2) On any such suspension or limitation, the Mayor shall cause to be affixed an appropriate notice at or near the parking place or space in question and it shall be unlawful for any person to park any motor vehicle in such parking place or space except for the purpose for which the suspension or limitation was made.

21. Vehicles exempted These By-Laws shall not apply to -

(a)any ambulance or any fire engine or any vehicle of the Armed Forces of the Federation, Visiting Forces, Police or the Post Office when used on official duty; (b)any vehicle in the service of any Government Departments authorised by or under any written law or under any other order having the force of any written law, to construct, erect or carry out electricity water or other public undertaking, in so far as such vehicle is being used in the construction, erection or carrying out of the undertaking, and; (c)a vehicle which has been directed to a parking space by a police officer in uniform in the course of his duty. 22. Obstruction by material or object and removal thereof (1)No person shall obstruct or cause or permit to be obstructed any parking space with any material or object. (2)A parking attendant or inspector may remove any material or object which is the cause of any obstruction aforesaid and the owner of such material or object may reclaim from the Mayor possession of such material or object upon payment to the Mayor of the cost of removal and custody of such material or object. 23. Parking forbidden if obstruction caused No motor vehicle shall be so parked in any road or parking place that it forms an obstruction to the free passage of vehicular traffic or pedestrians.

24. No parking No person shall park any motor vehicle -

(a)on any part of a road where double lines (being either continuous or broken) are placed; or (b)on that part of a road where a continuous yellow line is placed at the edge thereof; or (c)abreast of another vehicle; or (d)in a road or part of a road or place where a sign indicates that parking is prohibited; or (e)except in a road or part of a road or place where it has been specially designated by the Mayor as parking place or space. 25. Removal of motor vehicle and payment of removal and pound fees (1)Where any motor vehicle is - (a)parked in contravention of any of the provisions of these By-laws or a cause of obstruction; or (b)left or abandoned in any parking space for more than two continuous days; the Mayor may cause such motor vehicle to be removed in such manner as the Mayor thinks fit to a place of safety (hereinafter referred to as "the Pound") designated by the Mayor for that purpose and to detain such motor vehicle until released by an order of the Mayor.

(2)The release of any motor vehicle removed and detained by the Mayor under the provisions of paragraph (1) of this by-law shall be subject to the person in charge of such motor vehicle paying to the Mayor the fees as hereinafter prescribed. (a) Removal Fee RM (i) Motor vehicle not exceeding 1,500 Kg in weight 150.00 (ii) Motor vehicle exceeding 1,500 Kg but not exceeding 3,000 Kg in weight 200.00 (iii) Motor vehicle exceeding 3,000 Kg in weight 250.00 (iv) Motor cycle (including motor scooter) 100.00 (b) Pound Fee RM per day or part of a day (i) For motor vehicle other than motor cycle 100.00 (ii) For motor cycle 30.00 (3)Every motor vehicle or motor cycle detained shall be at the risk of the owner of such motor vehicle or motor cycle. (4)A parking attendant or inspector or any person duly authorised by or on behalf of the Mayor may render such motor vehicle immobile by having the motor vehicle locked by the use of any device as the Mayor may think fit and no person shall remove such vehicle or temper with the locking device. On the request of and subject to the owner or person in charge of such motor vehicle paying to the Mayor such fee of not exceeding RM150.00 as may be determined by the Mayor, the Mayor shall remove the locking device and release the motor vehicle. 26. Non liability of the Mayor for loss in respect of motor vehicle, motor cycle, material or object removed The Mayor or any person duly authorised by him who when enforcing these By-laws shall not be liable for any loss or damage to the motor vehicle or motor cycle, material or object or to any fittings or contents of such motor vehicle or motor cycle, material or object so removed or detained by the Mayor under the provisions of these By-laws.

27. Notification of removal and detention When a motor vehicle or motor cycle or material or object is removed or detained in pursuance of the provisions of these By-laws, the Mayor shall with all reasonable dispatch give notice in writing to the owner thereof with a copy of such to the police if the name and address of such owner be known, of the removal or detention of the same and that if possession or release of such motor vehicle, motor cycle, material or object is not claimed within the period prescribed under by-law 28(1) such motor vehicle, motor cycle, material or object shall be disposed off.

28. Disposal of motor vehicle, motor cycle, material or object (1)If the expiration of 21 days from the date the notice referred to in by-law 27 was given to the owner of the motor vehicle, motor cycle, material or object so removed or detained and such owner fails to claim for possession or release thereof of such motor vehicle, motor cycle, material or object the Mayor may dispose off such motor vehicle, motor cycle, material or object by public auction or in such other manner as he thinks fit. (2)Notwithstanding the provisions of paragraph (1) of this by-law the Mayor may dispose off the material or object in question in the manner aforesaid at any time if the material or object is of a perishable nature. (3)The proceeds of the motor vehicle, motor cycle, material or object so disposed off shall be given to the owner of that motor vehicle, motor cycle, material or object less any costs in connection with such disposal, fees or excess charges or compound due and payable under the provisions of these By-laws. (4)If the proceeds referred to in paragraph (3) of this by-law are not claimed by the owner within twelve months from the date the motor vehicle, motor cycle, material or object was disposed off the proceeds shall be credited to the revenue of the Mayor of the City of Kota Kinabalu. 29. Prohibition of trade or business No person shall use any motor vehicle parked in a parking space for the purpose of carrying on any trade or business except in the case of goods vehicle for the delivery of goods and on payment of the parking charge or display of a coupon or payment advice.

30. Prohibition of repairs No person shall repair a motor vehicle or permit a motor vehicle to be repaired in any parking place except in cases where repair is necessary to enable the motor vehicle to be removed from the parking place.

31. Prohibilion of washing or cleaning No person shall wash or clean or cause or permit to be washed or cleaned any motor vehicle in a parking place without prior approval in writing of the Mayor.

32. Persons permitted in parking place No person other than a parking attendant or inspector, driver, person in charge or passenger of a motor vehicle parked in a parking place shall be or remain in such parking place.

33. Removal of ticket or coupon or advice note or compound prohibited No person other than a person authorised by the Mayor shall remove or caused to be removed any parking ticket or coupon or payment advice or advice note or compound affixed to the windscreen or any conspicuous part of a motor vehicle whilst being parked in any parking place or space.

34. Provision of signboard The Mayor shall provide a signboard at each parking place indicating whether it is a half hourly or hourly or two hourly parking place, short term (Type A) or medium term (Type B) or long term (Type C or D or E) parking and may erect such signs and signals as may be considered necessary for the direction of regulation of motor vehicles within the parking place.

35. Emergency In the case of emergency, any person authorised by or on behalf of the Mayor or any police officer in uniform, may move or cause to be removed to any place he thinks fit any motor vehicle left in any parking place or space.

36. Mayor not liable for loss or damage for motor vehicle or motor cycle parked in a parking place The Mayor shall not be liable for any loss or damage to any motor vehicle or motor cycle or the fittings or contents of any motor vehicle or motor cycle parked in any parking place.

37. Exemption (1)The Mayor may at his absolute discretion vary the parking charge or the controlled hour specified in Table 1 and Table 2 of the First Schedule to these By-laws or exempt any parking place from being charged or otherwise as specified under these By-laws. Notice of such variation or exemption made thereof shall be placed at or near such parking place. . (2)The Mayor may at his absolute discretion exempt any person or motor vehicle from any provisions of these By-laws. 38. Penalties Any person who contravenes any of the provisions of these By-laws shall be guilty of an offence and shall on conviction be liable to a fine not exceeding RM5,000.00 and in addition there shall be paid to the Mayor any costs, fees or any other charge or charges or compound due and payable under the provisions of these By-laws.

39. Registered owner's liability In case of contravention of or failure to comply with any of the provisions of these By-laws the registered owner of the motor vehicle or motor cycle shall be presumed to have contravened or failed to comply with such provisions if the person (not being the registered owner) who actually contravened or failed to comply with such provisions is not known or cannot be found.

40. Compounding of offences The Mayor may compound any offence under these By-laws by collecting from a person reasonably suspected of having committed such an offence a sum not exceeding RM500.00 and on payment of such sum of money no further proceedings shall be taken against such person in respect of that offence.

41. Repeal The Kota Kinabalu Municipal Council (Parking Places) By-laws 1982 as amended is hereby repealed.
