KOTA KINABALU MUNICIPAL COUNCIL (TAMUS) BY-LAWS, 1980
(G.N.L. 25 of 1980)
In exercise of the powers conferred upon it by sub-section 1 of section 50 of the Local Government Ordinance, 1961, the Kota Kinabalu Municipal Council (hereinafter called "the Council") has made the following By-laws:-
1. Title and commencement.
These By-laws may be cited as the Kota Kinabalu Municipal Council (Tamus) By-laws, 1980, and shall be deemed to have come into operation on the 1st day of January, 1979.
In these By-laws;
means an open air market established and declared by the Council to be a Tamu by notice posted on the Notice Board of the Council, and at the Tamu ground.
No person shall sell any commodity not being manufactured within the Council's jurisdiction in any Tamu except with a valid licence which may be issued by the Council at its discretion and subject to such conditions as may be imposed.
The following fees shall be paid for licences issued under by-law 3:-
(a) Cooked foods (noodle soup or fried, cooked rice etc.) (monthly) ... 10.00
(b) Local products (vegetables, fruits, tobacco, etc.) (monthly) ... 2.00
(c) Fish, meat, mutton, fowls etc. (monthly) ... 5.00
(d) Manufactured products (such as clothings, straw hats, basketries etc.) (monthly) ... 5.00
5. Rental of stalls.
The rental charge for each of any stall provided by the Council shall be ... 5.00 per month
6. Tamu days schedules.
The Tamu days schedules for the following areas shall be as follows:-
Telipok Tamu ... ... every Thursday of the week.
Menggatal Tamu ... ... [Subs: GNL 36/87]
Inanam Tamu ... ... [Subs: GNL 36/87]
7. Commencement time.
All Tamus shall commence from 5.00 a.m onwards.
8. Tamu Master.
The Council may in writing appoint any person to be a Tamu Master for a Tamu who shall be charged with the keeping of order in and the general management of the Tamu.
Any person who:-
(a)sells any commodity in any Tamu without a valid licence or contravenes the conditions of a licence issued under these By-laws;
(b)takes or attempts to take into any Tamu any intoxicating liquor;
(c)constructs or extends any Tamu stall without the prior approval of the Council;
(d)has in his unlawful possession in any Tamu any fireworks, firearms or any offensive weapon; or
(e)fails to comply with any lawful direction given by the Tamu Master,
shall be guilty of an offence and shall be liable to a fine of not exceeding one hundred ringgit.
10. Cancellation of licence.
The Council may suspend or cancel a licence if the licensee -
(a)has not renewed the licence on its date of expiry; or
(b)has been convicted of any offence under these By-laws.
