KOTA KINABALU MUNICIPAL COUNCIL (DAIRIES AND DAIRYMEN) BY-LAWS, 1966
(G.N.L. 33 of 1966)
In exercise of the powers conferred upon it by section 71 of the Public Health Ordinance, 1960, the Jesselton Town Board has made the following By-laws-
1. Title and commencement.
These By-laws may be cited as the Kota Kinabalu Municipal Council (Dairies and Dairymen) By-laws, 1966, and shall come into operation on the 1st day of July, 1966.
2. Interpretation.
In these By-laws :-
"dairy"
includes any farm, cowshed, milking house, milk store, milk shop or other premises from which milk is supplied on or for sale, or in which milk is kept or used for the purpose of sale or manufacture into butter, cheese, dried milk or condensed milk for sale, or in which vessels for sale of milk are kept, but does not include a shop from which milk is supplied only in the properly closed and unopened vessels in which it is delivered to the shop, or a shop or other place in which milk is sold for consumption on the premises only;
"dairyman"
includes an occupier of a dairy, a cowkeeper, and a purveyor of milk;
"daily farm"
means any farm, cowshed or other premises being a dairy on which milk is produced from cows;
"daily farmer"
means a dairyman who produces milk from cows.
3. Registration of dairy farmer.
(1)
No person shall carry on the trade of a dairy farmer unless he is registered with Council as a dairy farmer.
(2)
The fee for such registration shall be five ringgit per annum.
4. Registration of dairymen.
(1)
No person, not being registered as a dairy farmer, shall carry on the trade of a dairyman unless he is registered with the Council as a dairyman.
(2)
The fee for such registration shall be five ringgit per annum.
5. Registration of dairy farm.
(1)
No place shall be used as a dairy farm unless it is registered with the Council as a dairy farm.
(2)
The fee for such registered shall be five ringgit per annum.
6. Registration of dairy.
(1)
No place, not being registered as a dairy farm, shall be used as a dairy unless it is registered with the Council as a dairy.
(2)
The fee fro such registration shall be five ringgit.
7. Health certificate.
Any person applying for registration as a dairy farmer or dairyman shall produce a certificate of health from a Government Medical Officer or registered medical practitioner.
8. Discretion to register.
Any registration under these By-laws shall be in the absolute discretion of the Council.
9. Penalty.
Any person who contravenes any of the provisions of these By-laws shall be guilty of an offence and shall be liable to a fine of one thousand ringgit.
10. Cancellation of registration.
The Council may cancel the registration :-
(a)of any dairy farmer or dairyman :-
(i)if such dairy farmer or dairyman is convicted of any offence under these By-laws or under any other written law relating to dairy farmers, dairymen, dairy farms or dairies and the use of weights and measures; or
(ii)if, on certificate of a Government Medical Officer or a registered medical practitioner, such dairy farmer or dairyman is suffering from a contagious or infectious disease;
(b)of any diary farm or dairy, if any person is convicted in connection with such dairy farm or dairy of any offence under these By-laws or under any other written law relating to dairy farmers, dairymen, dairy farms or dairies and the use of weight and measures.
12. Repeal.
Part III of the Jesselton Town Board (General) By-laws, 1956is repealed.
