TIMBER ROYALTIES (REBATES DISALLOWANCE) ENACTMENT, 1972

[SABAH ENACTMENT NO. 16/1972]

An Enactment to modify certain provisions in certain agreements and licences entered into or issued under the Forest Enactment, 1968 in relation to rebates on timber royalty granted thereunder.

ENACTED by the Legislature of the State of Sabah as follows:

1. Short title and commencement.

(1)This Enactment may be cited as the Timber Royalties (Rebates Disallowance) Enactment, 1972 and shall come into force on the 1st day of January, 1973.

(2)This Enactment shall be construed as one with the Forest Enactment, 1968.

2. Interpretation.

(1)In this Enactment, unless the context otherwise requires—

"timber licence" means any grant, licence agreement, contract, licence or permit relating to the felling, collecting or removal of timber, made, entered into or issued under the Enactment; and "the Enactment" means the Forest Enactment, 1968.

(2)All words used in this Enactment shall have the same meanings as assigned thereto in the Enactment.

3. Disallowance of rebate.

Notwithstanding the provisions in the Enactment or provisions of any timber licence, the rates of royalty payable by any concessionaires, licensees or permit holders shall be as may be prescribed from time to time under the Enactment and no reduction on basic royalty shall be granted to any such concessionaires, licensees or permit holders and it is hereby declared that any provisions contained in any timber licence for the time being in force relating to the reduction on basic royalty on any ground whatsoever shall cease to have effect and force forthwith.
